Attorney Fali Lin has practiced law since 1993 and is currently a Senior Partner at Winkler Partners. His principal experience includes business strategy matters; intellectual property disputes in the film, television, and music industries; patent litigation; startup and venture investment work; regulatory compliance for pharmaceutical and cosmetics retail chains; and other complex disputes. In recent years, he has led several of Taiwan’s major high-stakes LED patent infringement matters. Major Patent Matters

LED patent infringement matters (2022–2024): The client and its distributors faced three consecutive patent infringement lawsuits with aggregate claims totaling NT$230 million. The cases involved both invention patents and design patents. After representation, the client obtained civil judgments in its favor; the asserted patents were either invalidated (revoked) with finality or found by the court to have grounds for invalidity.
Giant design patent matter (2019): The client brought a patent infringement action and lost at first instance. We were retained on appeal and obtained a reversal with a damages award. The court also issued an interlocutory ruling favorable to our side confirming the asserted design patent had no grounds for revocation, establishing the foundation for patent validity in the case.
In-store pickup (“store-to-store”) patent matters: Including (i) IP and Commercial Court Judgment 106 Xing-Zhuan-Su-41, (ii) a resolution adopted at the Supreme Administrative Court’s April 2015 (104/4) judges’ conference, and (iii) Supreme Administrative Court Judgment 104 Pan-352—resulting in multiple favorable outcomes in which key “in-store pickup” patents were held invalid.

AI

Taiwan’s first prosecutorial disposition on AI and copyright: A “one-click” AI-generated image was determined not to be protected under copyright law.

Key Pharmaceutical / Cosmetics Matters

Eisai (Japan): We have assisted with compliance for key pharmaceuticals and health products, including Chocola BB, Lenvima (anticancer drug), and Leqembi (Alzheimer’s therapy).
Sudan dye contamination incident in cosmetics (2025): Assisted a well-known cosmetics brand from the initial reporting through the administrative investigation (no penalty imposed), and served as counsel in the criminal investigation (not named as a defendant), providing crisis management and legal support from the outset.

Landmark Music / Entertainment Matters

Wu Qing-feng (吳青峰) and related parties vs. Lin Wei-che Music Studio Co., Ltd. (2021): Criminal and civil copyright claims brought by a former manager; resulted in final outcomes favorable to the artist side (criminal acquittals and civil victories). Additional allegations (including computer-related offenses) also resulted in non-prosecution dispositions.
Confirmation that the management relationship no longer existed (2022): Final victory confirming the management agreement between the artists and the former manager had terminated, allowing the artists to pursue their careers independently.
Recovery of the “Sodagreen” trademark and parallel strategy for “Oaeen” (魚丁糸) (2021):
1. In addition to litigation, used a fast and confidential trademark cancellation route to revoke the former manager’s “Sodagreen” trademark and simultaneously secure new filings—successfully restoring the band’s trademark rights.
2. While the trademark dispute was ongoing, helped secure filings for “Oaeen” to ensure the artists’ career development would not be constrained.
Sodagreen damages/accounting settlement matter (2025): Handled compensation accounting issues under applicable law.
Music copyright dispute involving a well-known influencer channel (2024): Negotiated with a collective management organization to protect the client’s interests and provided legal opinions.

Dead Talents Society (鬼才之道) (2021; Director: John Hsu / 徐漢強): Sole legal counsel to the Taiwan production side (co-investor: Sony Pictures).
